These Terms and Conditions refer to the activity of supplying imported products from China by Open China, a brand owned by Searchprof, Lda., according to the customer’s express request.
1. Payment conditions. Payment of 100% of the invoice when awarding the cost of the goods, transportation between China and the customer, customs clearance and customs duties (it doesn’t include any inspections carried out by the Customs). If the payment conditions at the time of awarding have been other than the payment of 100% of the invoice, the rest of the ammount due to be paid should be settled before shipping the goods.
2. Prices. The prices and products presented to the customer are subject to change taking in account the quotation submitted. Prices don’t include VAT at the applicable rate as well as any other customs fees due to be paid by the customer when clearing customs. Prices on the quotations are expressed in Euros (€); all payments should be made in that same currency unless otherwise established through a written agreement between Searchprof, Lda. and the customer.
3. Cancellation. The amount paid by the customer when awarding will not be refunded in case of subsequent cancellation by the customer’s decision.
4. Payment failures. In case of failures in due payments, Seachprof, Lda. reserves the right to charge the customer with fees legally applicable in order to collect the amounts due to be paid as well as all the expenses arising from the debt collection process. Default interests at the applicable rate will be charged starting from the invoice due date.
5. Complaints. Complaints should be submitted in writting and received by Searchprof, Lda. within a maximum of 72 hours after the order had been delivered. Complaints made after this deadline will not be considered.
6. Delivery. Dates and delivery times are estimated by Open China based on information given by the factories and transportation companies. Searchprof, Lda. can’t held any liability for any delay in the delivery of orders resulting from the lack of payment by the customer, delays in customs, physical and/or human problems of transportation, any unforeseen resulting from the acting of carriers, problems in telecommunications, sudden climate change, natural disasters, floods, acts of terrorismo, accidents, fires or any event occured not under Searchprof’s control.
7. Samples. Open China can request, upon the customer’s request, for photos and/or virtual and physical samples of the products the customer is interested in. In case of any charges for sending physical samples, the customer helds responsibility for the respective payment.
8. Import/export taxes. By requesting the delivery of any product outsider Portugal’s national territory, the customer may be subject to the payment of import duties and taxes levied when orders are admitted in a particular destination. Searchprof, Lda. can’t held any responsibility for the payment of those charges. In order to obtain information on that matter, the customer must contact the customs of the country where the orders are to be delivered.
9. Change to “terms and conditions”. The “terms and conditions” contained herein are also available on www.openchina.pt and can be changed at any time without notice. In case of any difference between the version individually provided to the customer and the online version the latter should prevail. By the time the customer awards a certain product it is assumed he/she has accepted the amendments.
